【政策】新項目必須在開工前完成投保,《陜西省建筑施工安全生產責任保險實施方案》印發
近日(ri)(ri),陜西省住建(jian)(jian)廳印(yin)發《陜西省建(jian)(jian)筑(zhu)(zhu)施工(gong)(gong)安(an)全生產(chan)責任保(bao)(bao)險實施方(fang)案》。方(fang)案要(yao)求2020年9月1日(ri)(ri)起(qi),所有新開(kai)工(gong)(gong)的建(jian)(jian)筑(zhu)(zhu)施工(gong)(gong)項(xiang)(xiang)目(mu)(mu),必須在開(kai)工(gong)(gong)前(qian)完成投(tou)保(bao)(bao),并(bing)在辦理(li)項(xiang)(xiang)目(mu)(mu)安(an)全監督手續(xu)時提供建(jian)(jian)筑(zhu)(zhu)施工(gong)(gong)安(an)責險保(bao)(bao)單。2020年8月31日(ri)(ri)以前(qian)已開(kai)工(gong)(gong)的建(jian)(jian)筑(zhu)(zhu)施工(gong)(gong)項(xiang)(xiang)目(mu)(mu),項(xiang)(xiang)目(mu)(mu)部必須于9月15日(ri)(ri)前(qian)編(bian)制完成剩余工(gong)(gong)程量及(ji)合同價清(qing)單,經建(jian)(jian)設(she)單位和監理(li)單位確認后報項(xiang)(xiang)目(mu)(mu)所在地(di)住房和城鄉建(jian)(jian)設(she)主管部門(men);建(jian)(jian)設(she)單位應于9月25日(ri)(ri)前(qian)將(jiang)按基(ji)準費率和剩余工(gong)(gong)程量計算的保(bao)(bao)費一次性支付到位,項(xiang)(xiang)目(mu)(mu)部必須于9月30日(ri)(ri)前(qian)完成參保(bao)(bao)工(gong)(gong)作。

為認真貫徹落實(shi)(shi)《中(zhong)(zhong)共(gong)中(zhong)(zhong)央(yang)、國(guo)務院(yuan)關于推進(jin)安全生(sheng)產領域改革發(fa)展的(de)意(yi)見》和《陜(shan)西省高危行業強制實(shi)(shi)施安全生(sheng)產責任(ren)保險(xian)工(gong)作(zuo)實(shi)(shi)施方案(an)》(陜(shan)應(ying)急〔2019〕300號(hao))要(yao)求,充分發(fa)揮保險(xian)業的(de)風險(xian)管控和經濟賠償(chang)功能,防范化解建(jian)(jian)筑施工(gong)生(sheng)產安全風險(xian),保障建(jian)(jian)筑施工(gong)行業企業及相關人員的(de)權益,我廳研究制定(ding)了《陜(shan)西省建(jian)(jian)筑施工(gong)安全生(sheng)產責任(ren)保險(xian)實(shi)(shi)施方案(an)》,現印發(fa)你們,請結(jie)合(he)實(shi)(shi)際認真抓好(hao)貫徹落實(shi)(shi)。

陜(shan)西省建筑施工安全生產責任保(bao)險實(shi)施方案
為認真貫徹落實《中共中央、國務院關于推進安全生產領域改革發展的意見》和《陜西省高危行業強制實施安全生產責任保險工作實施方案》(陜應急〔2019〕300號)要求,切實發揮保險機構參與風險評估管控和事故預防功能,建立失信懲戒和守信激勵機制,防范化解建筑施工生產安全風險,保障建筑施工行業企業及相關人員的權益,現制定全省建筑施工安全生產責任保險(以下簡稱建筑施工安責險)實施方案如下:
一、總體要求
(一)指導思想。以習(xi)近平新時代中國特(te)色社(she)會(hui)主(zhu)義思想為指導,牢(lao)固樹立安(an)(an)全發(fa)展理(li)念,落實(shi)“安(an)(an)全第(di)一(yi)、預防(fang)(fang)為主(zhu)、綜合治理(li)”的(de)工作(zuo)方針,按(an)照政(zheng)策引導、政(zheng)府推動、市場運作(zuo)、雙向(xiang)強制(zhi)、防(fang)(fang)補結合的(de)原則,采取“統一(yi)險種(zhong)、統一(yi)費率、統一(yi)條(tiao)款、統一(yi)方案、統一(yi)保障(zhang)范(fan)圍、統一(yi)賠償標準(zhun)、統一(yi)數據(ju)管(guan)理(li)”模式,扎實(shi)做好全省建筑施工安(an)(an)責險實(shi)施工作(zuo),運用社(she)會(hui)資(zi)源和(he)經濟(ji)手段,推動企業落實(shi)安(an)(an)全生(sheng)產(chan)主(zhu)體責任,完善安(an)(an)全生(sheng)產(chan)管(guan)理(li)機制(zhi),強化事故預防(fang)(fang)和(he)風險防(fang)(fang)控(kong)能力,防(fang)(fang)范(fan)化解社(she)會(hui)矛盾,保障(zhang)經濟(ji)社(she)會(hui)穩定(ding)健康(kang)發(fa)展。
(二)工作目標。2020年9月1日(ri)起(qi),在全(quan)(quan)省建筑施(shi)工(gong)行業(ye)(ye)強(qiang)制實(shi)施(shi)建筑施(shi)工(gong)安責(ze)險,覆蓋(gai)建筑施(shi)工(gong)行業(ye)(ye)全(quan)(quan)體從業(ye)(ye)人(ren)員,完善全(quan)(quan)省建筑施(shi)工(gong)安責(ze)險事故預防(fang)、快捷(jie)理賠、費(fei)率調(diao)節等工(gong)作機制,實(shi)現全(quan)(quan)省房屋建筑和市(shi)政(zheng)基(ji)礎(chu)設(she)施(shi)工(gong)程項目安責(ze)險全(quan)(quan)覆蓋(gai),建立(li)多層次的生(sheng)產安全(quan)(quan)事故預防(fang)機制,促(cu)進(jin)全(quan)(quan)省建筑施(shi)工(gong)行業(ye)(ye)安全(quan)(quan)生(sheng)產標準化建設(she),提升安全(quan)(quan)生(sheng)產管理水平和應急處置(zhi)能力。
二、組織實施
(一)實施(shi)范圍(wei)。建(jian)筑施工安責(ze)險實施范圍(wei)為全省(sheng)所有新建(jian)、擴(kuo)建(jian)、改建(jian)、拆除及在建(jian)的房屋建(jian)筑和市政(zheng)基礎(chu)設施工程(含城市軌道交(jiao)通工程)項目。
(二)保(bao)障范圍。建筑(zhu)施工(gong)安(an)責險(xian)的(de)(de)(de)保險(xian)責任,包(bao)(bao)含(han)投(tou)保單位從(cong)業人(ren)員(yuan)人(ren)身(shen)傷(shang)亡賠(pei)(pei)償,第三(san)者人(ren)身(shen)傷(shang)亡和財產損失賠(pei)(pei)償,事故搶險(xian)救援、醫療救護(hu)、事故鑒定、法(fa)律訴(su)訟等全(quan)部費用(yong)。投(tou)保單位的(de)(de)(de)保障范圍應當覆蓋投(tou)保項目的(de)(de)(de)全(quan)體從(cong)業人(ren)員(yuan)并包(bao)(bao)含(han)勞務派遣人(ren)員(yuan)。建筑(zhu)施工(gong)安(an)全(quan)責險(xian)發生的(de)(de)(de)經(jing)濟賠(pei)(pei)償,不影響(xiang)依法(fa)請求工(gong)傷(shang)保險(xian)賠(pei)(pei)償的(de)(de)(de)權利。
(三)承保機(ji)構。建筑(zhu)施工(gong)安(an)(an)責險的承保機構應當具(ju)備國家法(fa)律法(fa)規要求的安(an)(an)全生產責任保險專(zhuan)業(ye)資(zi)質和承保能力(li),同時應具(ju)備以下(xia)基本條件:
1.有(you)良好的商業信譽;
2.具備償付各類建筑施工事故損失的(de)能力;
3.本省(sheng)保(bao)險機(ji)(ji)構或在(zai)我省(sheng)境內設立分(fen)支機(ji)(ji)構的保(bao)險機(ji)(ji)構,且在(zai)陜分(fen)支機(ji)(ji)構覆蓋面滿足全省(sheng)建筑施工(gong)事故搶險救援工(gong)作需要;
4.配備風險管理專業人員并具備相應的專業知識;
依據《陜西省高(gao)危行(xing)業強制實(shi)施安全生產責(ze)(ze)任保險(xian)(xian)(xian)工(gong)作實(shi)施方案》精神,為防止市場壟斷和數量過多造成(cheng)惡性競爭,建筑(zhu)施工(gong)安責(ze)(ze)險(xian)(xian)(xian)承保機(ji)構采取(qu)招投(tou)標或組織相關專家評審的(de)方式確定,并向社(she)會(hui)公開。鼓勵滿足以上(shang)條件的(de)承保機(ji)構組成(cheng)共保體,采取(qu)共保方式開展建筑(zhu)施工(gong)安責(ze)(ze)險(xian)(xian)(xian)工(gong)作。
省住(zhu)房和(he)城鄉(xiang)建設廳依據(ju)承保機(ji)構(gou)的(de)(de)商業(ye)信譽(yu)、償(chang)付(fu)能力、開展責(ze)任保險的(de)(de)業(ye)績和(he)規模(mo)、擁有風險管理(li)(li)專(zhuan)(zhuan)業(ye)人員的(de)(de)數量和(he)專(zhuan)(zhuan)業(ye)資格情況(kuang)(kuang)、為(wei)建筑施(shi)工企(qi)業(ye)和(he)項目提供事故預防服務(wu)和(he)事故損失(shi)賠償(chang)服務(wu)及投(tou)保單位投(tou)訴等(deng)情況(kuang)(kuang),對承保機(ji)構(gou)進行考核,依據(ju)考核結果實施(shi)動態(tai)管理(li)(li)。
(四)保費提(ti)取及費率確定。建筑(zhu)(zhu)施工(gong)(gong)(gong)(gong)安(an)責(ze)險按(an)照保本微(wei)利的(de)(de)(de)原則,確定房(fang)屋建筑(zhu)(zhu)和市政基礎(chu)(chu)設(she)施建設(she)工(gong)(gong)(gong)(gong)程(cheng)(cheng)(含城市軌(gui)道交通(tong)建設(she)工(gong)(gong)(gong)(gong)程(cheng)(cheng))項目(mu)費(fei)率(lv)(lv)(lv)為(wei)(wei)1.5‰,拆除工(gong)(gong)(gong)(gong)程(cheng)(cheng)項目(mu)費(fei)率(lv)(lv)(lv)為(wei)(wei)2‰,在工(gong)(gong)(gong)(gong)程(cheng)(cheng)造價中作為(wei)(wei)不(bu)可競爭(zheng)費(fei)用(yong)單(dan)獨列(lie)支(zhi),專(zhuan)(zhuan)款(kuan)專(zhuan)(zhuan)用(yong),任(ren)何(he)單(dan)位(wei)和個人(ren)(ren)不(bu)得(de)以任(ren)何(he)方式(shi)或(huo)形(xing)式(shi)攤派給從(cong)業人(ren)(ren)員個人(ren)(ren)。建筑(zhu)(zhu)施工(gong)(gong)(gong)(gong)安(an)責(ze)險費(fei)率(lv)(lv)(lv)依據投(tou)保單(dan)位(wei)的(de)(de)(de)安(an)全生產標準(zhun)(zhun)(zhun)化(hua)考(kao)評(ping)(ping)結(jie)果(guo)(guo)浮動,考(kao)評(ping)(ping)結(jie)果(guo)(guo)為(wei)(wei)優(you)良的(de)(de)(de)按(an)基準(zhun)(zhun)(zhun)費(fei)率(lv)(lv)(lv)的(de)(de)(de)80%計(ji)算(suan)(suan)保費(fei),考(kao)評(ping)(ping)結(jie)果(guo)(guo)為(wei)(wei)合(he)格的(de)(de)(de)按(an)基準(zhun)(zhun)(zhun)費(fei)率(lv)(lv)(lv)的(de)(de)(de)100%計(ji)算(suan)(suan)保費(fei);考(kao)評(ping)(ping)結(jie)果(guo)(guo)為(wei)(wei)整(zheng)改后合(he)格的(de)(de)(de)按(an)基準(zhun)(zhun)(zhun)費(fei)率(lv)(lv)(lv)的(de)(de)(de)120%計(ji)算(suan)(suan)保費(fei)。投(tou)保單(dan)位(wei)無安(an)全生產標準(zhun)(zhun)(zhun)化(hua)考(kao)評(ping)(ping)結(jie)果(guo)(guo)的(de)(de)(de)(含外省入陜企業)按(an)基準(zhun)(zhun)(zhun)費(fei)率(lv)(lv)(lv)計(ji)算(suan)(suan)保費(fei)。承保機構可依據建筑(zhu)(zhu)施工(gong)(gong)(gong)(gong)項目(mu)規(gui)模、工(gong)(gong)(gong)(gong)期、風險及投(tou)保單(dan)位(wei)安(an)全生產管理等情況(kuang),在上(shang)述費(fei)率(lv)(lv)(lv)標準(zhun)(zhun)(zhun)基礎(chu)(chu)上(shang)實施±20%的(de)(de)(de)費(fei)率(lv)(lv)(lv)浮動。
(五(wu))項目(mu)參保。建(jian)(jian)(jian)(jian)筑(zhu)施工(gong)安(an)責險以項(xiang)目為單(dan)位(wei)參保(bao)(bao),由項(xiang)目部(bu)在(zai)公布的范圍內自主(zhu)確定(ding)承保(bao)(bao)機構,參保(bao)(bao)費(fei)率按照項(xiang)目中標的建(jian)(jian)(jian)(jian)筑(zhu)施工(gong)企業安(an)全(quan)生產標準(zhun)化考評(ping)結果計算(suan)。2020年9月(yue)1日(ri)起,所(suo)有新(xin)開(kai)工(gong)的建(jian)(jian)(jian)(jian)筑(zhu)施工(gong)項(xiang)目,必(bi)須在(zai)開(kai)工(gong)前(qian)(qian)完(wan)成(cheng)投保(bao)(bao),并在(zai)辦理項(xiang)目安(an)全(quan)監督手續時提供建(jian)(jian)(jian)(jian)筑(zhu)施工(gong)安(an)責險保(bao)(bao)單(dan)。2020年8月(yue)31日(ri)以前(qian)(qian)已開(kai)工(gong)的建(jian)(jian)(jian)(jian)筑(zhu)施工(gong)項(xiang)目,項(xiang)目部(bu)必(bi)須于9月(yue)15日(ri)前(qian)(qian)編(bian)制(zhi)完(wan)成(cheng)剩(sheng)余工(gong)程量及合同(tong)價清單(dan),經建(jian)(jian)(jian)(jian)設單(dan)位(wei)和(he)監理單(dan)位(wei)確認后報項(xiang)目所(suo)在(zai)地住房和(he)城鄉(xiang)建(jian)(jian)(jian)(jian)設主(zhu)管部(bu)門(men);建(jian)(jian)(jian)(jian)設單(dan)位(wei)應于9月(yue)25日(ri)前(qian)(qian)將按基(ji)準(zhun)費(fei)率和(he)剩(sheng)余工(gong)程量計算(suan)的保(bao)(bao)費(fei)一(yi)次性(xing)支付到位(wei),項(xiang)目部(bu)必(bi)須于9月(yue)30日(ri)前(qian)(qian)完(wan)成(cheng)參保(bao)(bao)工(gong)作。
(六)責任限(xian)額。涉及人員(yuan)死(si)亡的(de)(de)(de)生產安(an)全(quan)事(shi)故(gu)(gu),建筑施(shi)工安(an)責險(xian)(xian)的(de)(de)(de)最低賠償限(xian)額(e),原(yuan)則(ze)上每人不得低于90萬元,并根據本(ben)省城鎮(zhen)居民(min)年(nian)度(du)人均可支(zhi)配(pei)收入的(de)(de)(de)變化適時(shi)進行(xing)調(diao)整(zheng)。對因生產安(an)全(quan)事(shi)故(gu)(gu)造成的(de)(de)(de)從(cong)業人員(yuan)受傷和財產損(sun)失、第三者人身傷亡和財產損(sun)失、事(shi)故(gu)(gu)搶險(xian)(xian)救援、醫療救護、事(shi)故(gu)(gu)鑒(jian)定(ding)、法律訴(su)訟等全(quan)部費用(yong)的(de)(de)(de)賠償,承保機構(gou)與投保單位應(ying)當在保險(xian)(xian)合同中(zhong)約定(ding)。
(七)保險期限(xian)。建(jian)筑施(shi)工(gong)安責(ze)險保險期限為企業購買(mai)工(gong)程(cheng)項(xiang)目安全(quan)責(ze)任保險之(zhi)日(ri)至工(gong)程(cheng)項(xiang)目竣工(gong)驗收備案之(zhi)日(ri)。
(八)保險理賠。建筑施工安責險投(tou)保(bao)單位(wei)發生事故后(hou),承保(bao)機(ji)構應積極協助(zhu)搶險救災和事故處理等相關工作(zuo)(zuo),嚴格按照合同約定(ding)(ding),及時啟動預(yu)付(fu)(fu)(fu)賠款機(ji)制,及時核定(ding)(ding)損(sun)失,在(zai)(zai)規定(ding)(ding)期(qi)限內(nei)支付(fu)(fu)(fu)賠款。承保(bao)機(ji)構應在(zai)(zai)投(tou)保(bao)單位(wei)報案(an)(an)后(hou)2小(xiao)時內(nei)到(dao)(dao)達事故現場,次日將預(yu)付(fu)(fu)(fu)資金(jin)準備到(dao)(dao)位(wei),5個工作(zuo)(zuo)日內(nei)向事故投(tou)保(bao)單位(wei)先行支付(fu)(fu)(fu)不(bu)低于估損(sun)金(jin)額80%的賠償金(jin),在(zai)(zai)事故結(jie)案(an)(an)后(hou)10個工作(zuo)(zuo)日內(nei)全(quan)部賠付(fu)(fu)(fu)到(dao)(dao)位(wei)。杜絕因(yin)推諉扯皮(pi)、討價還(huan)價造成不(bu)良社會影(ying)響。
三、事故預防服務
建筑施(shi)工安責(ze)險(xian)承(cheng)保機構(gou)應(ying)當建立生產安全事故預(yu)防服務保障制(zhi)度,明確并落實(shi)主要負責(ze)人(ren)及相關(guan)管理機構(gou)、人(ren)員的責(ze)任,完善質量和過程控(kong)制(zhi)、機構(gou)人(ren)員管理、檔案管理、投訴處(chu)理、評價(jia)考(kao)核等管理制(zhi)度。
承保(bao)機(ji)構要建立(li)健(jian)全(quan)(quan)(quan)事故(gu)(gu)預(yu)防服務(wu)(wu)工作(zuo)機(ji)制,提取不(bu)低于(yu)總額20%的(de)保(bao)費建立(li)事故(gu)(gu)預(yu)防服務(wu)(wu)基金,用于(yu)協(xie)助投(tou)保(bao)單(dan)位開展事故(gu)(gu)預(yu)防、風險防控、安全(quan)(quan)(quan)生(sheng)產(chan)標準化建設(she)、文(wen)明工地和長安杯創建等工作(zuo)。承保(bao)機(ji)構可以自建或委托(tuo)相關社會化服務(wu)(wu)機(ji)構,采取企企聯(lian)(lian)合(he)、企校聯(lian)(lian)合(he)的(de)方式,建立(li)健(jian)全(quan)(quan)(quan)安全(quan)(quan)(quan)生(sheng)產(chan)教(jiao)育培訓機(ji)構,組織安全(quan)(quan)(quan)生(sheng)產(chan)專家隊伍(wu),按照《安全(quan)(quan)(quan)生(sheng)產(chan)責任保(bao)險事故(gu)(gu)預(yu)防技(ji)術(shu)服務(wu)(wu)規范》(AQ 9010-2019)要求開展事故(gu)(gu)預(yu)防技(ji)術(shu)服務(wu)(wu),主要協(xie)助投(tou)保(bao)單(dan)位和工程項目(mu)開展以下工作(zuo):
1.為(wei)投保(bao)單位員工、安管人員和特種作業人員提供安全生產教育培訓和職業病(bing)防治宣傳教育;
2.安全風(feng)險辨識(shi)、評估和安全評價;
3.安全(quan)生產(chan)標(biao)準(zhun)化、信(xin)息化建設;
4.生產安全事故(gu)隱患(huan)排查(cha);
5.安全生產應急預案編制(zhi)和(he)應急救援演練;
6.安全生產科技(ji)推廣應用;
7.其(qi)他有(you)關事故預(yu)防工作(zuo)。
承(cheng)保機(ji)(ji)(ji)構(gou)按照(zhao)持續改進的原則,每年至少(shao)為(wei)投保單(dan)位(wei)開展1次安(an)全(quan)(quan)風險(xian)辨識、評估和安(an)全(quan)(quan)評價或生產(chan)安(an)全(quan)(quan)事(shi)故隱(yin)患排查(cha)服(fu)務。承(cheng)保機(ji)(ji)(ji)構(gou)的技術服(fu)務不免除投保單(dan)位(wei)承(cheng)擔(dan)的安(an)全(quan)(quan)生產(chan)主(zhu)體(ti)責任。承(cheng)保機(ji)(ji)(ji)構(gou)開展服(fu)務時,投保單(dan)位(wei)和工(gong)程項目應積(ji)極(ji)配合(he),并對評估排查(cha)發現的生產(chan)安(an)全(quan)(quan)事(shi)故隱(yin)患進行整(zheng)改。對拒不整(zheng)改重大事(shi)故隱(yin)患的,承(cheng)保機(ji)(ji)(ji)構(gou)應及時報告項目所(suo)在地住房(fang)和城(cheng)鄉建設主(zhu)管部門。
四、保障措施及工作要求
(一(yi))強化(hua)組(zu)織領(ling)導。省(sheng)(sheng)廳(ting)成(cheng)立由廳(ting)分管負責(ze)(ze)人任組(zu)長,廳(ting)安(an)(an)委會(hui)成(cheng)員(yuan)單位(wei)主(zhu)要負責(ze)(ze)人為組(zu)員(yuan)的全(quan)省(sheng)(sheng)建筑施工(gong)安(an)(an)責(ze)(ze)險(xian)(xian)工(gong)作(zuo)領(ling)導小(xiao)組(zu)(以下(xia)(xia)簡稱“領(ling)導小(xiao)組(zu)”),對全(quan)省(sheng)(sheng)建筑施工(gong)安(an)(an)責(ze)(ze)險(xian)(xian)工(gong)作(zuo)進行(xing)監督和管理。領(ling)導小(xiao)組(zu)下(xia)(xia)設辦公室(shi),辦公室(shi)設在廳(ting)工(gong)程質(zhi)量(liang)安(an)(an)全(quan)監管處,負責(ze)(ze)具(ju)體監督、指導、協調全(quan)省(sheng)(sheng)建筑施工(gong)安(an)(an)責(ze)(ze)險(xian)(xian)監管工(gong)作(zuo)。具(ju)體職責(ze)(ze):
1.指(zhi)導和協調全(quan)省建筑施工安責險運(yun)行工作(zuo);
2.對(dui)承保機構的工作行為(wei)進行監(jian)督,督促整(zheng)改存(cun)在的違(wei)法違(wei)規(gui)及(ji)違(wei)約行為(wei);對(dui)拒不整(zheng)改的,向領導小組(zu)提出處理建議;
3.綜合承(cheng)保(bao)單位日常管(guan)理工作、承(cheng)保(bao)理賠服務、事故(gu)預(yu)防服務、客戶投訴等情況對建筑施工安責險承(cheng)保(bao)機構(gou)進(jin)行評(ping)價,并將評(ping)價結果(guo)作為保(bao)險機構(gou)動態管(guan)理的主要(yao)依據(ju)。
(二)推進工(gong)作落實(shi)。各級(ji)住房和(he)城鄉(xiang)建設主(zhu)管部門負(fu)責本轄區建筑施(shi)(shi)工(gong)安責險(xian)工(gong)作組織(zhi)實(shi)施(shi)(shi)。主(zhu)要職責:
1.對保險機(ji)構(gou)承保行(xing)為(wei)及理賠等相關服(fu)務實施監(jian)管;
2.對轄區建筑施(shi)工項(xiang)目安責險爭議依照合同進行(xing)調解,接受(shou)并處理(li)有(you)關(guan)賠案(an)投訴;
3.核(he)查保費和事(shi)故(gu)預防費提取及使用情(qing)況;
4.及時上報本地(di)區(qu)建(jian)筑(zhu)施工安責險違法違規及違約行為(wei)的查處情況和處罰建(jian)議(yi)。
(三)加強(qiang)督導檢(jian)查(cha)(cha)。各級(ji)住房和城鄉(xiang)建(jian)設(she)主管(guan)部門要(yao)(yao)將建(jian)筑施(shi)工(gong)(gong)(gong)安責險推行(xing)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)納入(ru)年度安全生產工(gong)(gong)(gong)作(zuo)(zuo)(zuo),統一思想認(ren)識,加強(qiang)組織領導,下大(da)力推動(dong)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)落實,切實把建(jian)筑施(shi)工(gong)(gong)(gong)安責險工(gong)(gong)(gong)作(zuo)(zuo)(zuo)作(zuo)(zuo)(zuo)為安全生產監管(guan)的一項基礎性工(gong)(gong)(gong)作(zuo)(zuo)(zuo)抓實抓好(hao)。要(yao)(yao)強(qiang)化工(gong)(gong)(gong)作(zuo)(zuo)(zuo)措施(shi),自2020年9月1日(ri)起,采取(qu)行(xing)政(zheng)執法、檢(jian)查(cha)(cha)巡查(cha)(cha)、工(gong)(gong)(gong)作(zuo)(zuo)(zuo)督導等形(xing)式(shi),督促建(jian)筑施(shi)工(gong)(gong)(gong)企業投保建(jian)筑施(shi)工(gong)(gong)(gong)安責險,并(bing)在工(gong)(gong)(gong)程項目開工(gong)(gong)(gong)前(qian)安全生產條件審(shen)查(cha)(cha)時(shi)把是否(fou)按規定參保建(jian)筑施(shi)工(gong)(gong)(gong)安責險作(zuo)(zuo)(zuo)為一項重點內(nei)容。
(四)加強動態管(guan)理(li)。各級住(zhu)房和(he)城鄉(xiang)建(jian)設(she)主(zhu)管(guan)部門要(yao)加強對(dui)承保(bao)(bao)(bao)機構(gou)(gou)的(de)動態管(guan)理(li),推動承保(bao)(bao)(bao)機構(gou)(gou)發揮建(jian)筑(zhu)施(shi)工(gong)安責險的(de)主(zhu)體作用,加強宣傳,強化服(fu)(fu)務(wu)(wu),積極協助(zhu)企業(ye)和(he)項目(mu)積極投保(bao)(bao)(bao)建(jian)筑(zhu)施(shi)工(gong)安責險,確(que)保(bao)(bao)(bao)做(zuo)到應(ying)保(bao)(bao)(bao)盡保(bao)(bao)(bao)。對(dui)于賠付及(ji)時、服(fu)(fu)務(wu)(wu)周(zhou)到,投保(bao)(bao)(bao)單位(wei)反映(ying)好的(de)承保(bao)(bao)(bao)機構(gou)(gou),要(yao)及(ji)時總結(jie)表彰并(bing)記入良(liang)好行為記錄;對(dui)于隨(sui)意突破費率標準范(fan)圍(wei)、惡意競爭或因在理(li)賠過(guo)程中推諉(wei)扯皮、討價(jia)還價(jia)造成不良(liang)社會影(ying)響的(de)承保(bao)(bao)(bao)機構(gou)(gou),發現1次,將進(jin)行全省(sheng)通報批評;發現2次,對(dui)承保(bao)(bao)(bao)機構(gou)(gou)主(zhu)要(yao)負責人(ren)進(jin)行約談;發現3次,將清出建(jian)筑(zhu)施(shi)工(gong)安責險承保(bao)(bao)(bao)機構(gou)(gou)范(fan)圍(wei)。

附件:建筑施工安責險相關概念釋義
一、本省(sheng)行政區域內所有(you)新建(jian)(jian)、改建(jian)(jian)、擴建(jian)(jian)、拆(chai)除及在(zai)建(jian)(jian)的(de)房屋建(jian)(jian)筑(zhu)與(yu)市政基礎(chu)設施工(gong)程項目,包括外(wai)省(sheng)入(ru)陜建(jian)(jian)筑(zhu)施工(gong)企業承建(jian)(jian)項目。
二、意外(wai)傷害(hai)部分(fen)包括與施工(gong)(gong)企(qi)業(ye)或(huo)項目部形成勞動(dong)關系(xi)(包括事實勞動(dong)關系(xi))的施工(gong)(gong)現(xian)場(chang)所(suo)有務(wu)工(gong)(gong)人(ren)員及因工(gong)(gong)作關系(xi)進入施工(gong)(gong)現(xian)場(chang)進行(xing)監督(du)、檢(jian)查、參觀、指導等行(xing)為的所(suo)有人(ren)員。
三(san)(san)、第三(san)(san)人人身傷(shang)亡和財(cai)(cai)產損失:因(yin)發生與(yu)承保(bao)工程(cheng)直接相(xiang)關(guan)的(de)(de)安(an)全責(ze)任事故(gu)引(yin)起工地內(nei)及(ji)鄰近區(qu)域的(de)(de)第三(san)(san)者人身傷(shang)亡或(huo)財(cai)(cai)產損失,依(yi)法應由被保(bao)險人承擔的(de)(de)經濟賠(pei)償(chang)責(ze)任,保(bao)險人按(an)限(xian)額負責(ze)賠(pei)償(chang)。
四、搶險救(jiu)援(yuan)(yuan)費用(yong):被(bei)保(bao)險人(ren)(ren)在保(bao)險單載(zai)明的(de)工(gong)(gong)作場所內發生(sheng)(sheng)生(sheng)(sheng)產安(an)全事故,應由投(tou)保(bao)單位(wei)負擔的(de)因采取緊(jin)急搶險救(jiu)援(yuan)(yuan)措(cuo)施而支出的(de)下列必要、合(he)理的(de)救(jiu)援(yuan)(yuan)費用(yong)(包(bao)括(kuo)施工(gong)(gong)單位(wei)按(an)照(zhao)項目部制(zhi)定的(de)應急救(jiu)援(yuan)(yuan)預案開(kai)展搶險救(jiu)援(yuan)(yuan)所產生(sheng)(sheng)的(de)費用(yong)),保(bao)險人(ren)(ren)按(an)照(zhao)保(bao)險合(he)同約定負責賠償:涵蓋參(can)與救(jiu)援(yuan)(yuan)人(ren)(ren)員(yuan)勞(lao)務費用(yong);參(can)與救(jiu)援(yuan)(yuan)器材、設備(bei)的(de)租(zu)賃、使用(yong)費用(yong);救(jiu)援(yuan)(yuan)工(gong)(gong)具購(gou)置費用(yong);生(sheng)(sheng)產安(an)全事故現場發生(sheng)(sheng)的(de)醫療搶救(jiu)費用(yong)等。
五、事(shi)故(gu)鑒(jian)(jian)(jian)(jian)定(ding)費(fei)用:與保險事(shi)故(gu)有關的(de)鑒(jian)(jian)(jian)(jian)定(ding)費(fei)用,包括但不限于醫學鑒(jian)(jian)(jian)(jian)定(ding)費(fei)用,如(ru)法醫鑒(jian)(jian)(jian)(jian)定(ding),公安(an)DNA鑒(jian)(jian)(jian)(jian)定(ding)等;職(zhi)能部門形成事(shi)故(gu)責任報告過程(cheng)中(zhong)所需(xu)費(fei)用等。
